Complaint Details

I have bought a site in a private layout constructed by a builder known as M/s Happy Home Construction Ltd (BG Road, Bangalore). The builder has registered the site in my name for 2670 sq ft and received the money for it. He has also promised to provide water/electricity to the layout via development agreement.

Now after re-surveying the site my site measures only 2450 sq ft. And there is no water/electricity has been provided to the layout till now.

Repeated visits to builder’s office to resolve the issue personally did not yielded any results. Builder is not responding at all. He is trying a delaying tactics saying that he will talk to other parties (Ramesh babu/Ravi Raju) involved in this and get back to me. But he never gets back to me.

The builder has changed the name of the company to ‘City Square’ recently due to unknown reasons to me.

Date wise facts:

23/06/2003 : Happy home Agent Vasu/Steven promised me that the site will have a 2670 sq ft and Layout will be developed with facilities like Water/ Electricity, club house etc. I Booked the Site no 162 by paying Rs 25,000/- .

28/06/2003: payment for the 2, 70,000/- made towards the site.

17/07/2003: Development agreement between me and the opposite party done. Copy of the development agreement is attached with the document. The agreement was to develop tar roads, providing water, sewage connection, 24 hour security, club house, swimming pool and plantations in the layout.

18/07/2006: registration of the property (for 2670 sq ft) was done in Koramangala, Bangalore done of the property in my name.

The site was marked for 60X44.3 with yellow stones.

31/07/2003: Khata transfer has been done to my name for this site.

31/07/2003 to 1/03/2007: Frequent visits done to check the site fro encroachment.

5/4/2007: I found that the site owner of 161 has encroached 240 sq ft in my site I lodged a complaint to site owner as well as the builder personally. The yellow stones of the marking were thrown out.

10/04/2007: site owner has encroached only 50 sq ft remaining (190) was not there (less?) as per the City square engineer (Srinivas) when he re-measured the sites.

04/05/2007: Ravi Raju promised that he will talk to Ramesh babu to refund for the land which is less. I have given all my contact details to call me back.

04/05/2007 to 06/07/2007: Mr Ravi Raju either avoids me or tells me that he will talk to Ramesh babu and call me back. But that call never came.


Solution of your complaintCompensation expected from me from the Builder: I expect the compensation for the less area of 190 sq ft in the current rate.  
ActionWill go to consumer court. I have already sent a notice to the builder and no response from him until now (i week). I will wait from two weeks and file a complaint in the consumer court of Bangalore.
