>Sub:- Legal Notice for deficient services and for retaining the documents and vehicle of my client .
>Dear Sir,
> I have been instructed by Mrs Neelam Narula r/o H.no. 5826,Sector 38 West,Chandigarh ( Herein referred to my Client ) to serve you with following legal notice:-
>
>1. That my client approached your office to purchase a new car on 2/6/08 The executive of your company offered to purchase the old vehicle of my client for a sum of Rs 2 lacs and offered to give the new vehicle at the rate of Rs 5,23, 974.At the time when the deal was on my client told your executive that the insurance policy of her old vehicle i.e Hundyai Santro was to be transferred on the new car to be purchased by her. When my client placed the order of the new car then your executive changed his stand and told that the price of the old car of my client to be adjusted would be Rs 1,85,000/- and not Rs 2lacs as told and even refused to adjust the old insurance of my client on the new car. Since my client had no other option she raised a dispute on the spot but had to succumb to the pressure of your employees as my client had deposited the entire payment of the new car with the cashier of Berkeley Ltd.,and on her asking the money was not being returned to her and the deal was not being cancelled dispite the fact that my refused to buy the new car as she forced to pay more as per the settlement and she was forced to accept all illegal demands of your employees. My client had to pay a sum of Rs 5880/- etc. towards the insurance of the new car. You charged a sum of Rs 5,23,974 whereas the invoice shows the value of the new car as Rs 5,21,324 also refund this excess amount to my client.

>3. That the mental agony of my client did not end here and when the delivery of the vehicle was given to my client the documents of the new car were not released to my client for the reasons best known to you.It may be pertinent to mention here that after receiving the payment the dealer has no power to retain the papers of the new vehicle as per the judicial pronouncements .

>4. That my client has time and again being asking you to release the documents of her car new as well as old car but no heed has been paid to her request till date. Even my client has told you to return her old car i.e Hyundai Santro bearing Regn.No. CH 03 R 3260 which is your possession as my client is not willing to sell the same and has offered to pay the amount adjusted by i.e Rs 1,85,000/- which is less as per the agreed amount as you have cheated my client and played a fraud with my client, but you intentionally and willfully are not returning the vehicle of my client and are retaining the same without the consent of my client. You have forced my client to pay extra amount for the new car and thereby caused loss to my client. You are hereby asked not sell the old car of my client and incase you do so you all shall be responsible all further consequences and you are asked to return the vehicle to my client henceforth failing which legal recourse would be taken by my client for redressal of her grievance .You are also asked to release all the documents to my client and refund the extra money received by you from my client .Incase you fail do so the same ,I have explicit instructions to initiate legal proceedings against you for the redressal of the grievance of my client and incase my client is forced to knock the door of the court you shall be responsible for all the costs and expenses incurred by my client.
